Procedure on post-verdict proceedings

Instruction on how to proceed after a delivery of a court verdict stating the infringement of third party’s rights by a domain name registrant.

  1. The proceeding on a verdict of the court of general jurisdiction.

    • The party, whose rights have been infringed by the registrant of a domain name in consequence of registration or use of a domain name, shall submit to NASK a legally valid verdict of a court of general jurisdiction stating such infringement.

    • NASK provides the party, mentioned above, with a form "Request for submitting the Offer for concluding the Agreement on Domain Name Maintenance through a Partner", (hereinafter referred to as: Form) and an instruction on further proceeding with indicated deadline for submitting to NASK a correctly filled and signed Form, specifying the consequences of exceeding the deadline. The Form may be filled in only for one entity being the party mentioned above.

    • The party, mentioned above, shall choose a NASK's Partner, by means of which a domain name will be registered and then serviced, make therewith appropriate arrangements on registration and service of the domain name. Attention! In case the application has been positively examined, applicant, by choosing a particular Partner, will no longer be allowed to specify other Partner. Transfer of domain name service to other Partner will be possible as soon as the domain name is registered.

    • The party, mentioned above, shall submit to NASK a correctly filled and signed Form within the deadline determined by NASK.

    • Once NASK receives a correctly filled and signed Form, it shall allow a Partner, specified in the Form, to submit the offer for registration and maintenance of a domain name for the applicant; in case the domain name is not registered by the Partner within the time period specified by NASK, the domain name will become available again.

    • After registering a domain name through a Partner chosen by the applicant, NASK begins to maintain that domain name for the applicant (a new registrant); the domain name shall start to be maintained on concluding an agreement between this party and NASK on terms set forth in the .pl Domain Name Regulations.

    • NASK may refuse to sign the agreement mentioned above, in particular, if a correctly filled and signed Form is not submitted within the deadline determined by NASK, formalities have not been completed by a Partner chosen by the applicant and in cases set forth in the .pl Domain Name Regulations.

  2. Proceeding on a verdict of the arbitration court.

    • The party whose rights have been infringed by registrant of domain name in consequence of registration or use of a domain name, shall submit to NASK a legally valid verdict by a court of general jurisdiction accepting the verdict of the arbitration court, stating such infringement. Due to the content of the provisions of the Code of Civil Procedure, it should be taken into account that the proceeding, resulting from the petition for the reversal of the verdict of the arbitration court, to which the obtained recognition decision pertains, may affect the capacity or timing of NASK taking actions mentioned below.

    • NASK provides the party, mentioned above, with a form "Request for submitting the Offer for concluding the Agreement on Domain Name Maintenance through a Partner", (hereinafter referred to as: Form) and an instruction on further proceeding with indicated deadline for submitting to NASK a correctly filled and signed Form, specifying the consequences of exceeding the deadline.     • In the event of a ruling that does not establish an infringement of the rights of the other party to the dispute by the registrant of a domain name, in particular dismissing the claim, information regarding the dispute and the consequences thereof may be maintained by NASK during the period provided by law for filing a petition for the reversal of the verdict of the arbitration court, as well as during the period of continuation of the dispute, falling after the issuance of such a ruling.
