Service regulations for registration and maintenance of .EU domain names (hereinafter: Regulations)
- Registration and maintenance of .EU domain names is conducted by the European Registry of Internet Domain Names (hereinafter referred to as "EURiD") [ www.eurid.eu ].
- Naukowa i Akademicka Sieć Komputerowa, a research and development unit with registered office in Warsaw (hereinafter: "NASK") conducts services related to the maintenance of an .EU domain name, comprising activities listed on the Internet site of http://dns.pl/eurid/english/oplaty_en.html (hereinafter: "maintenance services").
- Services related to maintenance are preceded by registration of a .EU domain name. The registration may be performed through NASK, using the electronic customer panel (hereinafter: "the panel"), in accordance with instructions contained therein, or through another entity. In the latter case, the services related to maintenance are transferred to NASK through the panel, in accordance with instructions contained therein.
- Using the panel requires the use of an ID delivered by NASK and of a password known only to the person who has registered the .EU domain name or who is in the process of such a registration.
- Information required by the instructions in the contents of the panel, sent through the panel to NASK, represent . together with these Regulations . the entire agreement between NASK and the person who has registered a .EU domain name (hereinafter: "the agreement").
- The agreement is entered into as of the day when NASK received the information required by instructions in the contents of the panel. The agreement is enforced once EURid registers the particular .EU domain name to which the agreement refers.
- NASK will perform the service as described in the Regulations immediately, as soon as it receives a confirmation that the full amount of the service fee has been blocked on the payment card account. The amount and titles of the fee are specified on the Internet site.
- The fee, once paid, is not refundable.
- The agreement remains in force throughout the period, for which it is paid up. The period of the agreement may be extended by another, similar period, as long as NASK receives a confirmation that the full amount of the service fee for the next period has been blocked on the payment card account, no later than 7 days prior to commencement of such a period.
- The following circumstances lead to termination of the agreement with immediate effect: EURid ceasing to provide the .EU domain name maintenance; lack of fee payment or transferring the services related to maintenance to an entity other than NASK; delivery of a court verdict, whereby it is stated that registration and maintenance of a specific .EU domain name lead to infringement upon a third person.s rights.
- Entering into the agreement does not result in the rise of any rights to the .EU domain name.
- Liability of NASK for a damage resulting from NASK.s application of the policy and conditions or other regulations regarding registration and maintenance of .EU domain names, as published by EURid or by institutions of the European Union, as well as liability for damage resulting from related to EURid or to institutions of the European Union, is excluded, and the contracting person undertakes not to pursue any claims against NASK in case if such a damage occurs.
- Exclusive responsibility for the content of the data submitted to NASK rests with the submitting person. In case if that person fails to inform NASK, through the panel, on the change of data necessary for performance of the agreement, or fails to submit such data until the deadline set by NASK, NASK performs the agreement based on the data available so far.
- 14. Matters not dealt with by these Regulations are governed by regulations of the Polish law, the policy i conditions regarding registration and maintenance of .EU domain names. Any disputes related to performance of the agreement will be settled by common court appropriate for the registered address of NASK.
- The Regulations are enforced as of 7th April, 2006.
